Privacy Policy
Datafolio ("Datafolio" or "we") may process personal data (the "Data") of users visiting the "Site" or using the applications developed by Datafolio in its own name or under white label ("the Application") (the "Users"). We place the protection of Data at the heart of our concerns and this Data Protection Policy allows us to inform you about the processing that we implement, in compliance with all European and French regulations on the protection of personal data and privacy, and in particular the General Data Protection Regulation 2016/679 of 27 April 2016 ("GDPR") and the Law No. 78-17 of 6 January 1978 relating to data processing, files and freedoms as amended.
1. Objectives of data processing
Your Data is only processed for the following purposes
- Improve our services and the functionalities of the Site and the Application;
- Ensure the security of the Site and the Application;
-Provide insurance intermediation and risk prevention services;
- Respond to your contact requests;
- Guarantee the exercise of your rights and the defence of our rights;
- Analyse the statistics of use of the Site and the Application;
- Create your personal account;
- Estimate the price of your insurance;
- Detect your mode of transport (car, bike, train, ski, walking, ...);
- Generate your insurance contract;
- Apply an insurance rate.

We process your Data (i) with your consent, which you may withdraw at any time; (ii) where it is necessary for the provision of our services or to respond to your requests; (iii) where it enables us to comply with a legal obligation to which we are subject; (iv) to ensure our legitimate interests relating to the security of the Site and the Application, its proper functioning and to send you communications by email

2. Data processed
Only the Data strictly necessary to achieve the purposes specified above are processed. The Data collected may be the following:
- Data collected when you request a simulation: Address of the routes most frequently used by the User;
- Data collected when you request contact: Name, first name, email address;
- Data collected during use of the Site: connection data, data from technical cookies or tracers with your consent;
- Data collected when you download the Application: Name, first name and telephone number, password;
- Data collected when you use the Application: Name, first name, age, address, nationality, ID, geolocation data, data from the mobile phone's sensors (accelerometer, compass, magnetometer, gyroscope), technical logs, data on movement and use of one's mobile;
- Data collected in the event of a claim: Name, first name, information related to the claim, identity information of the insured's beneficiary or beneficiaries.
As soon as it is necessary, we thank you for updating your Data.
3. Recipient of the data
We only pass on your Data to our subcontractors and partners when this is necessary to achieve one of the objectives mentioned above. Finally, your Data may be transmitted to third parties legally entitled to access it upon specific request, in certain cases provided for by law: judicial authority, administrative authority, etc. Your Data may also be communicated to third parties if this is necessary to protect and/or defend our rights or to ensure compliance with these provisions.
Your Data may be transferred outside the European Union, with the necessary guarantees, to our authorised service providers.

4. Duration of data retention
We retain the Data collected through cookies for 25 months.
We only keep your Data for 3 years from the last contact with us, unless you request deletion.
Thus, the validity of your registration to theSite expires 3 years after your last use. You may decide at any time to delete your account by sending a written request by email to the following address: dpo@datafolio.io.
In addition, in accordance with applicable law, Data necessary to defend our rights is retained for a period of 5 years after the end of the relationship with us.
However, your Data may be kept for longer if a longer retention period is permitted or imposed by virtue of a legal, contractual, fiscal or social obligation.
5. Your rights
In accordance with the Regulation (in particular Articles 15 to 22 of the RGPD), you have the following rights concerning the processing of your Data, within the legal limits:
- Right of access: to obtain information on your Data and a copy of your Data;
- Right of information: to obtain information on the conditions of processing (recipients, purposes, categories of data, etc.); - Right of rectification: to correct or update your Data when they are inaccurate or incomplete; - Right of objection: to object to processing for reasons relating to the protection of personal data.);

When you exercise your rights, we undertake to reply as soon as possible and, in any event, within the legal time limits.
